OXFORD, Ohio —

A man accused of raping a Miami University student is out on bond Tuesday.

Officers responded to North College Avenue at around 1:20 a.m. on July 24 after receiving a 911 call from someone reporting a sexual assault. The caller stated that he found a Miami University student lying in a front yard crying. The student told the passerby that she had been raped.

The student said she had accepted a ride from an uptown bar from a man she did not know.

Oxford police identified the man as Zachary Frankart, 21, of Clyde, Ohio. Police said Frankart is a construction contractor working in Oxford.

A criminal complaint said Frankart helped the 21-year-old woman out of his truck “because she was unable to walk” and “assisted her to the grass area in front of the address.” Court documents said he then got on top of her and raped her before stealing her cell phone and leaving.

“It was surprising to me,” Lt. Lara Fening said. “This is an example of a predatory person that is taking advantage of a situation or someone’s vulnerability.”

Police said the 911 caller helped police solve the crime quickly.

“A bystander heard this person in distress and inquired about it,” Fening said. “Not everybody would be willing to do that… Some people are worried and scared or worried about repercussions of getting involved and this person was not.”

One of the conditions of Frankart’s bond is that he’s ordered not to travel to the city of Oxford.

Frankart is charged with rape and theft after police said he stole the victim’s cell phone after the alleged assault.

Frankart is due in court again next month.
